✎ EN My husband needs a uk spouse visa but I'm not yet in the uk

    I'm a british citizen living in China working as an English teacher. In 2008 I met my husband and we had a baby (we were not married at the time). I went back to the UK for the birth because my chinese is terrible and I needed doctors I could understand. I tried to get my partner a visitors visa so he could come over for the birth but we were unsuccessful 2 times which is another story.

    I stayed in England for a year so I had helpfrom my family with my son and then came back to China in January this year. Me and my husband married in March and had our wedding in July because my family came over for the wedding. Now however, I am really missing my family and my friends in England and I really want to go back with my husband and my son. My son's nationality is also British so he has no problem but how can I bring my husband back?

    In England I have no money and no property. My salary is really low here, it's enough to get by on but I couldn't save any. In England, there is my family home with plenty of room for us to live and we are welcome to stay there for as long as we want. I would still have no money until I found a job though and once I found a job I don't think the salary would be very high perhaps 12, 000pounds a year. My husband wants to start work as soon as he gets here so together we can save and find a place of our own, either renting or buying. I've missed all these new changes to the visa's, would he even be allowed to work during the first 2 years?

    What do we need to do to get his visa? Would it be easier if I went to England first? I could get a job and save money for a few months then I would have some money to show I can support him for a few months while he finds a job? Or I could try to find somebody who would offer him a job upon approval of his visa?

    Thing is I really want us to go together, he's already missed the first year of his sons life and I don't want us to be split up again. I want us to be able to go together. Is there any way this could be done? I'm really desperate for help.

    The second option that you mentioned is more realistic.

    Your husband is allowed to work as soon as he arrives in UK on a spouse visa but since you are going to be his sponsor, you will need to show that you have enough money to support your family AND you have suitable accomodation.

    Without that, I wouldn't go for spouse visa.

    How much money do they need to see from a sponsor? Would my family home be ok? My grandmother owns her home and paid off the mortgage about 20 years ago. It's 5 bedrooms (there's a small flat attached) and there's only my grandmother, my mother and her husband and my sister living there. There's still 2 bedrooms spare.

    Yes for accomodation part, that should be fine but you will of course need some documentary evidence from your granny that you three can live in her house. You should also get an official valuation which is basically a document confirming that the house will not be over-crowded once you three move in. Your local council should be able to do that for you. This is not compulsory but I would recommend it just to be on the safe side.

    For the sponsorship part, there is no specific amount but you need to show that you have enough money to support yourselves. Draw out a budget, put your income and all the expenses bills, food, transport etc and see if you earn enough for the three of you plus some money set aside for emergencies for example to answer ECO's questions like 'what if you loose your job?'.
