    Good morning,

i am posting this topic for my daughter who is an indian married to a french national.
Both are reisding in uk at present. The marriage took place in india in august 2006
and my daughter left for uk in sept, 2006. She got the rc stamped in her passport
in july, 2007 for 5 yrs. My son-in-law and daughter both hold good jobs in london for the past 3 yrs and 10 months. They purchased spacious apartment on lease.

Her in laws came to visit her last year. They started demanding dowry, her gold and claim her maternal property from india. As a result she stopped talking to her in-laws.
This irritated her husband and he wanted to divorce my daughter. Also he threatened her to quit the house although they own the property jointly. So my daughter started to stay seperately from jan, 2010. She still pays the share of her emi regularly to her husband.
Can my child ger her pr in 2011. My son-in-law is quite these days. He is not threatening about divorce. My daughter had excellent job in india prior to her marriage. She resigned it, hich was the biggest mistake. I would appreciate your valuable advice for her immigration status. She is our only child. Thanks in advance.

She arrived in UK in September 2006 ? If thats correct, then Yes. She can retain her residence rights even if she gets divorced. She will have to apply to Home Office for the retention of her residence on her own once the divorce is all done.

In other case, if she doesn't get divorced, she will be able to apply for PR anyway after the completion of five years of residence.

Thank you very much for your reply. I am only concerned how my daughter would get her husband's original passport/id at the time of applying for her pr and then for naturalisation.
What alternative steps she should take in obtaining them.

As she lives seperatively since jan,2010, would it be appropriate to give the new address
to ho and give alternate address of her office for future correspondence at the time of applying for pr & naturalisation.

    Anxiously awaiting for your reply.
