    Hi maybe somebody can help me with regards to this eea family permit? I am south african married to a eea national ( polish ) we are living in poland at present and i have polish residency, my wife has never lived in the uk only visited ,however i lived in the uk on a 2 year working holiday visa now we want to go to the uk to live and work ,can we apply or does she need to have a job offer first in the uk?

    I would say yes, she SHOULD have a job offer if you are applying for EEA Family Permit.

    Alternatively, she can also be self-sufficient or a student but that is more complicated.

    NO. She does not need a job offer first for the purpose of an initial entry/EEA Permit for her Spouse/Family Member. See also (eea Reg.12) http://www.opsi.gov.uk/si/si2006/20061003.htm#12

    However, as an EEA Family Permit would in this instance usually be issued/valid for 6 months and allows unrestricted employment in the UK for the duration. In the course of those 6 months it is expected that the EU citizen while exercising their treaty right in accordance to the Directive may applies for a Registration Cert (not compulsory though) using form EEA1 and their spouse/partner applies at the same time for a Five Year RC (Residence Card) using form EEA2.

    NOTE: As your wife is from an A8 country (Poland) thus she'll have to register under WRS as soon as she arrives UK otherwise her employment may be consider invalid for the purpose of immigration.

    Hi kkk thanks for the useful advise ,however i look at the application for the eea permit and where it says :reason for wanting to come to the uk what do we put in there aswell as : do you have accomadation?

    Well, I'd simply put 'accompanying my Spouse to the UK' and the answer would suffice for the accommodation as well.

    Are you using the online application? If not, then you only need to supply the infos which are relevant in your case.

    PS: VAF5 is the applicable form for EEA Family Permit!

    Thanks again very helpful and yes i'm using the online form as the british h com, only except the application this way here in poland.one more thing ,we have a joint bank account ,how much should we have to show them if equal to british pounds?

    Albeit it wouldn't harm to show/prove your financial circumstance, However the EEA Family Permit is not subject to any financial condition as the EU Citizens and their Family Members
    enjoy the right to move and reside freely within the member states (EU) in accordance to the Directive.

    Your right is derived solely from the marriage to your wife (EU National) thus you have same right as her, so you should be fine anyways.

    UK doesn't apply the directive. If it did, there wouldn't be any need for this permit in the first place.
