    The answer is No.

You must have met in real before you could apply for fiance visa. Besides I don't understand what do you mean when you say 'he has applied for CoA for marriage' since he doesn't need anyone because he is British.

Thanks for the assistant, kindly help me with this..

Coa-certificate of approval marriage. He has applied in the marriage registrar to get an approval of us to get married. Once that comes,we plan to submit that legal certificate with the passport copy to the british embassy in delhi.

As per him, the certificate is more than sufficient to proove the relationship. We plan to wed in india first then move to uk on a fiance visa to legally marry in uk.

Do you thnk it shud work.

OK let me get this straight for you.

1 - Only YOU can apply for CoA and not your boy-friend on your behalf.
2 - You can NOT apply for CoA if you are outside the UK. You MUST be IN the UK.
3 - He can NOT apply in the registrar office without a CoA.
4 - CoA is issued by the Home Office. Registrar offices have nothing to do with it.
5 - CoA also is not a proof that relationship is genuine. Its merely a document which says to the effect that 'OK you can marry'. Its never meant to say the relationship is genuine or prove anything else.
6 - and more important, if you go to UK on a fiance visa, you do NOT need CoA.

I don't understand why are you so worried about CoA when in fact you are planning to apply for a fiance visa and you wouldn't even need CoA. Also, if you get married in your home country and can get a marriage certificate, that would be enough to show as proof of relationship in the UK. You wouldn't need to re-marry and in that case, you would need to apply for a spouse visa and NOT fiance visa.

I am sorry if I sound disappointing but you first need to get your facts straight before making any move to avoid waste of time and money.

    Good luck

    Yousaf,

You have been of great advice and help buddy..No i dont mind you being blunt at all...
Now my next question is if given a chance between fiancee visa and spouse visa..which is quicker and has more chance to get through. I have heard that spouse visa take a lot of time and can get refused too. I don't want to get stuck after marrying my boyfriend, and without visa.

My concern is, he and I have not met. Will we be able to apply fiance visa? I guess you have already answered that NO.

    Am stuck.

You will not be able to apply for fiance visa unless you both have met in person. Thats one of the conditions for fiance visa application.

Spouse visa can indeed take longer but so can fiance visa. The time it takes changes on case to case basis. Provided you submit all the required documents with good supporting ones, it can be faster.

If I were you, I would go for spouse visa since it would mean going through the visa application misery only once and when issued, makes things easier and simpler.

    Good luck
