    Hi,

    Fingers crossed someone can help me with this...

    I am a UK resident, but a Hungarian citizen. I have received a registration certificate as an EEA national, exercising treaty rights in the UK. I have spent the last three-and-a-half years constantly employed full-time and living in the UK.

    My partner is a Malaysian national who had studied at university in Edinburgh. We have spent more than two years living together and now she is back in Malaysia. We want to get married in Malaysia, while I take a sabbatical from work, and return to the UK together.

    I was finding conflicting information, depending on the source, so it would be great if someone would know what to do in our situation.

    Firstly, does being a UK resident allow me to go through the process as if I was a UK citizen?

    I can always get hold of my birth certificate, but do I need to involve Hungary more than that?

    The ideal scenario would be to get married in Malaysia, return to the UK, and apply for a COA (or EEA2?).

    Is this realistic or does it get more complicated than that (which I suspect)?

    I'll be grateful for any advice, thank you!

    No, you are NOT taken as UK citizen just because you live in UK. You will still be taken as an EEA national.

    You don't need birth certificate or anything else from Hungary. Just produce your Hungarian passport/National ID card and thats it.

    You can get married in Malaysia, apply for EEA Family Permit for your wife to travel with you to UK which is issued for six months and once thats about to expire, you can apply straight for EEA2. No need for COA in this scenario.

    The only complication you can have would be that the issuance of EEA Family Permit in Malaysia can take longer than you would like.

    Make sure you take all the evidence of your living together, your relationship for example pictures, bills in your and her name on the address you were living on and everything else with you so you can submit them with your application for EEA FP.

    Hello again,

    the situation has changed a bit since my last post. We had some difficulties meaning travelling there was (and is) not an option - mainly for the sake of keeping my job secure.

    After a while my partner agreed to getting married in the UK instead, so that I don't have to take a career break.

    I was looking at the relevant government websites, but - as previously - I struggle to find a definite answer on how to go about it without risking issues with the UK Border Agency. The money is set aside for her flight, which would be ideally towards the end of this year.

    She would still need to buy a return ticket (I suppose) and would be considered a visitor upon arrival (I'd send a sponsorship letter, just to be on the safe side). Is it at all possible for us to get married when she's here and avoid her having to make another trip back to Malaysia? Certificate of Acceptance comes to mind, but I'm not sure about the forms needed at this point.

    Would she need anything apart from her passport and birth certificate (such as a registrar's letter to confirm she's unmarried)?
