I am a Polish national and my husband is a national of outside the EEA. We have lived and worked fulltime in Scotland earlier for 8 months during 2008 (hence, I didnt finish the WRS expected stay of 12 months).

We are coming back to Scotland in the end of July 2009 and have a few questions.

    1) I am accepted as a full-time postgraduate student with scottish government research scholarship and will be studying full time and do not intend to work. In this case, do I need to apply for WRS or can I apply for EEA1 directly?

    2) If I do not have to apply for WRS, can my husband apply for EEA2 together with me? (as soon as he gets a job)

[ I have read positive and negative responses here and there and am totally confused. To clarify our situation, I will have scholarship thus, will be self-sufficient (not self-employed) and my husband as he will be working, will be able to support himself.
We will also have a few grand in our bank account to show evidence that we will not be using public funds, etc. ]

I thank everyone in advance who replies with their experiences or have read about relevant issues.

Yes, you need apply to WRS! And your husband apply for Family member residence stamps (FMRS). Are you in Edinburgh?

Thanks Scotman but I have already found out that if I do not intend to work I don't have to apply for WRS and can apply directly to EEA1.
Moreover, WRS is even exempt if I plan to work only 10 hours a week and no more.
    I am in Aberdeen :)
