Unfortunately while the rules are clearly stated on the UK Visas website, that doesn't necessary mean that they'll issue you the permit. At least not me anyways.

I've been painfully made aware the the issuance of a visa is a privilege, not a right.

It's been over a month now since I last saw my beautiful, lovely wife, and all because the ECO chose to blatantly ignore all the evidence we submitted, and refused to issue the permit based on circumstances we've already proved when we made the application.

The only logical step forward is to make an appeal against the decision, but lawyers aren't cheap. It does upset and anger me why someone would choose to keep us apart. I can only imagine that it might have something to do with my nationality.

Why have you been refused permit ? on what grounds ? which nationality are you ? and more importantly, what documents did you submit alongwith your application ? The ECO needs to have very strong reasons to refuse a EEA Family Permit and you have vast rights of appeal. If you would share more detailed information, you are sure to get valueable help from this forum.

    Good Luck

Well, I've gotten a lawyer to help me with my case. She said that my application was a very strong one, and by refusing my permit they are in breach of at least 3 different laws!

I feel very cheated and powerless that the embassy would do this to me simply because I did not know the law. She has advised me to reapply, as it would be quicker than trying an appeal, but this time she will summarise all the evidence and also include a letter stating why my refusal was unlawful.

Definitely considering suing them as a means to recover costs and to make sure they don't treat innocent people in such a disgusting manner...

Well I dont know much but the fact should be said that UK is so so self confident and strong to the level they could break/breach the EU law that allows family member to accompany or join their EU spouse within the EU territories.

I was refused twice the EEA family permit, I have all the papers...I mean alllllllllllllll the papers and proves but they still dont believe for some unreasonable reasons of the phone call bills doesnt show my name and some other stuffs that shouldnt even be so as a EU family member which says no Immigration officer or embassy should ask for any prove or evidence except marraige certificate and passport.

And if holding an residence card as a family member then you can accompany or join ur EU spouse within the EU but the UK dont follow this Directive and even ask for so much papers like phone call bills, prove of financial stability(bank account),flight itenary, prove of accomodation and e.t.c, But all this shouldnt be asked from family members of an EU citizen according to the EU law which was even clarrified last month in Dublin. I visited Germany with this card and also Hungary alone with this card.

Its so unbelievable that the UK could mess or toy with the EU law and the EU commission is doing nothing about this issue, Anyone in my situation should just wait till early 2009 when this issue wether or not family member can accompany or join their EU spouse to or in the UK. This was the report I got from the EU solvent and anyone who wants to apply for the EEA family permit then good luck cus its fucking hell to get (like u are applying for a british passport).
