Please help!

The people at the foreigners office have keep refusing to accept my wife's application for residency. The have rejected the papers numerous times. There most recent reason is that they say my wife is not married to me!

I am a dual Canadian/British citizen and on our marriage certificate (from Korea - translated and apostilled) it says I am Canadian. So, they say that since she is married to a Canadian and not a Briton that she does not fall under the EU law.

The British Consulate has said that they can write a letter saying they recognize overseas marriages and that I am a dual citizen. The Spanish have said this is not sufficient and that they require a British marriage certificate.

I showed them the EU law where it states that they may not ask for additional documents outside those required and he just rolled his eyes and said "this is Spain, not Europe"

I have called the EU help line and they said they would contact me within 3 days, but that was 4 days ago.

Please help!

 

Has anyone ever tried to register under the "durable duly attested relationship" clause in the EU law. It says it is not a guaranteed right, but that if one applies and is denied then they must be provided with a written explanation for the denial.

I figure I could apply based on cohabitation. I can say I live with my wife and say the proof is our marriage certificate. It would be pretty hard for them to say my wife isn't in a relationship with me because I have dual citizenship.

Any ideas?
