My EEA2 application is pending. I submitted it when my EEA family permit expired and my husband had been on WRS for the required 12 months.
Had to request my passport back so I can travel. Was told on the phone that it would not affect my application.
Received my passport back in the mail, with an accompanying letter saying that I need an EEA family permit visa to re-enter the UK. I called up the Home Office to question this and was told that yes, a visa is required to re-enter the UK. My question to them was HOW can one obtain a visa abroad when the Home Office in UK has all my original documents (marriage certificate etc)? Applications are only accepted at embassies aborad with original documents. Answer - that's your problem.......
Has anyone experienced this before? Did people obtain visas to re-enter, or just come in as tourists?????????

If you are a non-visa national, you should be fine, especially if you intend to travel again within 6 months. However, it is possible that you will be asked additional questions about the situation, and you may even be delayed if you are referred to the supervisor. Just have a few phone numbers ready, bring your CoA and remain confident, then you should be fine.

I did the same thing, although I had not yet sent in my passport so I didn't have to ask for it back. I just kept a copy of our wedding certificate and the letter saying my application had been received. When I came back to the UK, I explained that I was still waiting for my residence card. No problems at all.

I'm American--I don't need a visa for travel to the UK. I also showed British passport control my EEA family permit. Easiest entry into the UK I've ever had actually.

    EEA2

    Hello Flamekat,

Was your EEA permit still valid when you came back into the UK? This is because my EEA permit has expired and i want to request my passport back to travel out but i am afraid that i might have a problem when entering at the airport and if i have to apply for another family permit, what is the risk involve when my application is still pending at HO?

    Thanx.

My Family Permit had expired three months prior to my departure. I think the key thing is that I'm not a visa national and anyway, I was able to show them the expired Family Permit, our marriage certificate (the original New York one and a photocopy of the apostilled international version), and the COA from the Home Office. I also had a photocopy of my husband's French id card, but the only thing the immigration officer looked at was the Family Permit. I was prepared for a battle, but it was easy.

Keep in mind that the Home Office is taking its time returning passports. I've been waiting for over two weeks for mine.

I called Croydon. The number is 0870 606 7766 Make sure to have all your info handy and tell them you have to travel asap. The fax number they gave me was for a landline, so I'm calling back tomorrow.

It's cheaper to call the HO on 0207 035 4848 (it is the exact equivalent of the 0870 number)
