Shoptime HELP EEA Spouse visa application

    I am married to a dutch citizen
    and got 6 months UK spouse visa from Pakistan
    Now 5 months are over and i want to apply for 5 years
    or indefinite visa. So what documents will i need?
    I have got 2 months payslips which i can send.
    I am renting a double bed room only, i can arrange a letter which will say
    that i pay 80 per week which includes bills and council tax. Will that be enough?
    If there are any other documents needed please let me know

    You would need to prove that your spouse is exercising a treaty right in the UK. E.g:

    Employed
    Self-employed
    Self-sufficient
    Studying
    Actively looking for work may also be considered

    It is also important that you both are cohabiting to prove that your marriage is genuine. Is this the case for you?

    hold on there.. how can you get a UK spouse visa if you are married to a dutch citizen? Do you mean you have a EEA Family Permit?

    1.EEA Family Permit is not UK Spouse visa.
    2. You may start applying for eea2 (residence card) if your partner is exercising s/he right in the UK.
    3. Once you have reside in UK for 5 years, you may apply for Indefinate leave or naturalisation if the requirement is fulfilled.
    4. search on this forum. alot of us are going thru the eea2 application.

    ad 3. I thought you need at least one year of ILR/PR before you can apply for naturalisation. That would make it at least six years then (at least under the current law...)?

    from my understanding.. once you have the 5 years residence card, you can apply for naturalization much earlier if you feel that you have integrated fully into the community & society.
    (just last night, my husband and i were talking on this subject and he read from some UK or EU law on naturalisation)

    the general rule is after 5 years or on the 5th year, one can apply for naturalization.

    but then again, it doesn't make much sense, because if you are a eu citizen or a spouse of a eu citizen, you have the right to move, work and live in another host member state without being a danger to host member.. so then why do we need/must to apply for eeafp, eea2, or ILR?

    oh well! got to do what we got to do.

    It might not make sense, but they are still necessary, at least at the moment:
    1) employers and job agencies may still refuse employment without seeing some nice sticker or stamp in the passport
    2) although the spouses wouldn't need visas as per the directive (still ignored by many countries) you need some proof that you are resident in an EEA country. Some embassies refuse to issue visas to non-residents.
    3) naturalisation finally can bring all those hassles for the spouse to an end eventually. Some countries do allow dual-citizenships which may make life easier.
