The idea is that you give the letter to your employer. The employer phones the Home Office, confirms that the case is under consideration, and that you have the right to work in the mean time. Then you should get the job.

The bigger issue is getting a NI number. A lot of employers will not consider you if you do not have a NI number. And the people at the job center usually have no clue about European rights.

    EEA2 application

I found this site very informative so I am replying to some who have not got the NI. 1. I left dublin with a family permit valied 6 mths. 2. I then applied for a job got it and then rang the NI branch closest for where i work in west brmpton was tottenham and went for an interview adn got my NI no approved. No hassle they were quite helpful but always checking for fraudlent data which is good. 3. Spouse is Irish so she is not working now and looking after my daughter. I applied for EEA2 in november 2007 and am still wating for my letter from the home office as I only got a reply that the application has been received and in the meantime you can work while the application is being considered. from what i read 6 mths is the time they reply you. Now it is about 5mths so still waiting. 4. applying for a bank account is to do it before you submit you eea2 application as the passport for both me and spouse is with home office. I had great difficulty with bank account. What I would say the best to get a bank account is get a sky account with your current address, with that then apply for a bank account. Most banks will reject a current account and the only one I got was hsbc with a basic account. There is a catch though make sure that you know only after 3 mths you can aplly for a current account as that is what most banks do. So have enough cash before you bank in. At the moment I am still waiting for my reply.. Hope this helps anyone..

getting a job with certificate of application/delay

Hey how u doing?yeah i do understand your point and i think you were a bit lucky cos as for me,i've applied since may 2007 and was sent the certificate of application stating i've got the right to seek employment.I've been trying with this document ever since and all to no avail.I even called the job centre telling them my situation and they equally said they cant issue me NI cos i aint got my passport with me to id myself.I explained the situation but they insisted the law has changed and except i've got my Passport, they cant do nothing about it.They eventually gave me a reference number asking me to call them when i receive my passport from the home office.Up till this date ever since,i've not heard from the home office nor been able to secure a job with my certificate of application.I've asked my solicitor to put pressure on the home office and they keep saying we'll hear from them soon. What i've finally concluded is to start calling them myself but i dont know if that's the right step to take cos saying i'm frustrated is just an understatement,i'm just in a state of limbo and feel like a prisoner.Anyway, whatever advice you've got will be taken on board.

I had just sent off my application for EEA2 when I applied for a new job. I had to explain to my employer the full situasion. They very easily could've denied me the job on that basis (albeit given me a different excuse)

They kept asking me where my passport was after that and it got a bit hairy but after 5 months I finally got my passport with the EEA2 card back.

I did have trouble changing jobs with just my EEA1 card because everyone could see that it would simply expire in a few months. I was stuck in my current job with that.

I originally came here on a working holiday visa so I already had a NI number and bank account sorted out ages before

Hey mellowd, your situation is same with mine; that is to say that I was on a WHM visa (expiring 10.08) when I applied for an EEA residence card as my hubby and I tied the knot.

    I just want to know:

    1. When exactly did you apply for and get your card
    2. What supporting docs did your spouse send in (or vice versa if you're the sponsor)
    3. Did the HO comment on you switching from WHM to a residence permit?

My case is straight forward but after 4 months of no word my mind is beginning to play tricks on me! I just can't wait to get my passport back and know that my husband and I can make concrete plans for the future...

    Hi Plum.

Which card are you applying for? The first card I applied for was my FMRS after my WHM visa. It took 6 months to get (and as it only lasted 1 year, I really only had 6 months on it when I got it back)

I sent lots of documentation in. I sent even more in when I applied for the EEA1 and EEA2 cards, and that came back in 5 months.

The home office never commented on anything, as long as you're here legally whichever visa you are on you won't have an issue

    Thanks for the reply mellowd,

I have a valid WHM visa which expires in Oct. '08. My husband had already applied for his reg. certificate in August '07 & got it back in a month. I applied for the EEA2 residence card in January '08 and am still waiting...
We didn't send an overload of supporting docs, just what is required: our passports, marriage cert., my husband's most recent payslip (at the time) and registration certificate.

I reckon that if they need more proof they'll contact us

The issue of illegality doesn't come in at all, I think i'm just fretting due to the waiting. This is the longest I have ever had to wait for an immigration endorsement! But I believe it won't be for too much longer...

I got my COA in December'07 and started looking for a job in Jan. I eventually got two offers end of Feb, explained to both of the prospective employers my situation and neither of them had any problems with it. Obviously I chose only one job  and I am still here and have not had any problems working only with COA.
Though to be honest I did have NI and bank account sorted out ages before that.

    EEA2

    Hey Carl009

You are in the same situation like me but mine is even worst.I applied on the 29.04.2008 for a residency card and till date no word from them.I have sent a fax to the customer unit in Croydon and made several calls but no response from them.I sent them a fax on Friday and today made a call but was told they have not started looking at complaints from Friday and asked for a few days for complaints to be looked into.I am actually desperate because i have had many opportunities but no letter of acknowledgement. Hope things will get sorted before the end of this week.

    Cheers

Carl and Njangah, I am not sure if you are aware that a couple of us are working on a joint petition to be lodged with the European Parliament regarding the misapplication of EU regulations by the HO and maladministration practices. At the moment I am trying to gather as much evidence as is possible to show that COAs are not being issued 'immediately', passports are not speedily returned to applicants when requested and residence card applications take well over 6 months to process.

Your situations would make great evidence to back this petition as the HO is clearly in violation of the law. Would you be willing to share your experience by way of submitting evidence and signing the joint petition?

You can read more about this here http://www.ukresident.com/forums/index. ... opic=70485

Looking forward to hearing from you both

    Hi all.

I think it would be best to create a seperate thread about the delay of your COA. People who could be helping you with it more would probably overlook this thread as it's got to do with finding a job with a COA

    Re: EEA2

The letter is meant to be sent immediately, I wonder why it takes time to send some people's letter and some people's COA comes after 2-3weeks.

I also called them and i was told to send a complain to a fax number, my documents has been delivered since 16th of May.
Has anyone in this situation gotten his/her letter later on? if yes, how many weeks did it finally take for the COA to arrive.

    EEA2

    Hey Carl009,

I still gave the Customer service unit a call this morning(Friday) but the lady who picked my call could not still give me a convincing reason why they havent sent those COAs but did apologized.I dont really know the type of pressure they need for them to know that they are sitting on someone's future. Two months no word after receiving my documents, this is absurd.Let find a way to come out of this malaise.

    Thnx
