✎ EN EEA2 overdue - need advise

    Hi all,

    My EEA2 application is 2 weeks overdue (it means I have been waiting for 6,5 months stuck in this country). We were silly and naiv enough to send the original passports.
    i sent 2 letters of complaint last week - no answer yet.
    am i right that since they did not ask for recent slips or some other docs - my application is still in the queue?

    I was thinking of calling them and requesting the passport from Croydon - how long does it take, if I go there and ask? can be done the same day?
    I hope they will still proccess the application and will not be considered withdrawn?

    Other suggestions are most welcome!

    My one is now 10 days overdue. I applied 1st of November 2007.Although my application is different from yours because it is for retention of right of residence as a former spouse of EEA national. Still,it is indeed inexcusable for them (HO) to be floating EU law. I think the best option is to keep waiting because they claim they are inaudated with applications which they might use as a defence if you commence legal action to try and force a decision.

    I am not a lawyer, but I would be more optimistic about legal action. They may receive a lot of applications, but this is hardly unexpected. The applications due now did arrive 6 months ago, so that would have been plenty of time to schedule accordingly. But if you go to court, make sure that you have concrete and proven damages.

    As for getting the passport back, it used to take about a week. Going in person may get you the passport the same day, but that is only if the passport is in Croydon, and not in the new office in Liverpool. So it is worth a try, but I would not bet on it.

    In fact this may be the best way to prove damages. If you have to book a ticket, that could be a lot more expensive last minute. Just calculate the difference, and you have your damages.

    Hi guys,
    well our EEA2 application is now almost 6 month (still some days left)...
    I do not expect that the Home Office is sending the passports back on time. Just from the messages that I read through in this forum.
    I rang the Home Office today and ask for the progress.
    The only answer that I got was that the case is under consideration.
    Well I know that after being longer than 5 month without passport.
    He told me to write a letter to Liverpool and ask about the progress of my application. I'm not sure if this will help anyway...
    I recently wrote to Solvit and they were suggesting me to persue my issues.
    If this is the way how europe comes and works together, I do not understand why Britain is part of it...
    keep waiting....

    Hey medlana, surely you should have gotten your passport back from the HO by now?
