    Hi,
    My wife is Italian National ,living here from 6 years.she has got her EEA1 Registration Certification. We married in May 2007.
    Right now I have applied for Student Visa Extension which expired on Octobor 2007.My case is under consideration ,Home office is still not answering my application.
    I should have applied Under EEA2.but i didn't do that.?

    If they refuse my student visa,can i apply under EEA2 or
    can i apply even now while my case is with them?
    but my student visa finished in octobor 2007.

    You are lucky: the EU right for free movement is granted automatically, so you are already covered. The application is just for confirmation in form of a sticker in your passport.

    Yes, you can still apply. However, if you do apply, your student visa application is considered withdrawn. There is no easy way to go back to the national immigration path.

    what does mean by there is no easy way to go back to the national immigration path??

    Also can you please tell me ,Can i Apply for HSMP?would it be better.?

    Right now.Am i eligible to work Full Time and do business?
    If yes...then what documents can i show to employers?
