    Hi my readers .

    I would like to apply for my FMRS ( I am non EEA country national) and I do wonder I will be given FMRS if my partner (Polish) would be full time studnet?

    First of all my Polish partner will only be registered for WRS only for few months so wont have full rights and then the partner want to study full time and I am wondering If I will be eligable for FMRS if my EU partner will be studnet and wont be working ( or will only will have small part time job ) ?


    Anybody been in same position ?


    And one more thing while I will apply for my FMRS can I work already till the home office make decision ? As they will sned me letter kind of confirmation that i have applied ...can I show that to employer that I will be soon with my full rights ?

    Yes, theoratically you can apply for FMRS but its going to be harder.
    Your partner will need to show that s/he has enough money to support both of you. Although being a student also comes under the definition of 'exercising treaty rights', its more complicated when it comes to proving financial resources. You will need to obtain certificates of income/resources/funds from a qualified accountant and/or valuer.
    Besides, for FMRS, as far as I have seen, proof of income/funds is not enough only on EEA national's part. You will also have to show that you also get income from work/home whatever.

    About work..No, unless you get a decision on your FMRS, your status will remain what it already is. If your current immigration status doesn't allow you to work, you can't work just because you have made an application for FMRS. But of course, if your FMRS is granted ( which is not as sure as you think ), then you would be allowed to work.

    and what about if my wife only study part time and have aslo part time job ?
    will I quilify for FMRS ? is she eligable for WRS and than residency if she will only be part time worker ?
