✎ EN Australian woman, meets Polish man in England

    HELP!

    Here's the scenario from hell.
    Aussie woman on working holiday visa goes to England.
    Polish Man, CIS card, goes to England.

    they meet, they fall in Love, they move in together. But, Polish man's divorce is not finalised before Australian woman's work permit expires (gotta love that stupid stay for 2 years work for 1 rule)

    Australian woman attempts to sort out the whole mess from Australia. Cant apply for fiance visa without Polish man having english residency.

    Working holiday makers visa restricted time in the UK, so cant qualify as unmarried partner because didn't have long enough time living together in the UK.

    CIS holders do not need to apply for the workers registration scheme. But no-one at the home office seems to know if you need to be on the WRS if you have worked under the CIS for your first year in England, then switched to a wage.

    Cant get a residency certificate if he does need to be on the WRS, if he applies for the WRS then its a 12 months slog for a residency certificate.

    immigrations suggestion: apply for visit to marry, marry, LEAVE THE COUNTRY, and then apply under EEA law, from Australia. Hands up if you can afford to cross the globe twice?

    If Aussie woman applies for a working holiday visa to Ireland, (which she feels she can qualify for) marries Polish man in, say, Gibraltar or something, and then applies to stay in whichever country they choose to live in under the EU treaty, will we have any issues?

    Its one thing to think outside squares, its another to think outside countries.

    And what about if god forbid, they try to tackle australian immigration???

    Yes,you could do that.
    Once married you could apply for a Family Permit in Dublin.

    P.S
    Do not attempt to use EU law in Ireland.
    DOJ,department of justice in Ireland has basically closed this route.Lots of people are stranded at the moment and all applications are refused.

    Yes, the EU law can be a bit strange if you want to get together. The problem is that it was written with mobility in mind, so the main case they considered was a family moving together to a different EU state.

    Don't go to Ireland, they seem to be a bit weird at the moment. What about Poland? It is easy to get married there? Getting the EEA family permit from Poland once you are married should be pretty easy.

    The other thing you can always try is to just send the application and see what happens. I have the feeling that you will never get a reliable answer to a question from the Home Office unless you actually apply.

    To extend thsths' comment, what about marrying in Australia? It's an expensive option, but at least the bureaucracy will be familiar to you: it does seem to be a recurring theme on here that it's simpler to marry in a foreign country, then apply for entry to the UK as a family.

    Polish still need visa for AUS,so that may cause difficulties.
