    hi i need help about my friend he married franch citizen and lately they are seperated he still have his marrige residence and expier in 2010 been to this country 9 years and his working its there any chance he can apply in his own for leave to rmain.? thank you for your help

    If your friend is non-EEA and would want to apply on his own for leave to remain later on, Home OFfice will ask for documentation proving that he is still married to the EEA national, of whcih I think you want to skip and hopefully get away with.

    Sadly, since your friend is non-EEA, he may get away with staying in the UK until the expiration of his permit, but since they are separated/divorced, Home office law states that the individual's status ceases to be when the relationship has ceased or does not exist anymore, as the only reason why a non-EEA national can stay here in this example is because of the union with the EEA national.

    polskasweetie thank you. so there no way he can apply for extantion visa or somthing? i heard its there new law comes out last june in 2006 if your married with eaa memebr and you been together for 3 ywears at least and you been working for morethen year and you divorced you can apply for recident permit. somthing like that im not sure about but im sure its there law regarding this matter. any suggestion? thnk you
