Shoptime EU National married to none EU national

    Hello I was wondering if someone could shed some light for me. My fiance who is a none EU national was removed from UK a month ago as an overstayer. We had planned our wedding in November of this year in her home country due to her parents are not able to travel due to health reasons,and are still going ahead with the wedding next month.
    My question is what procedure to I follow after we are married next month. I will be going to my country's embassy to register our wedding, after that do we go the British Embassy in her country to apply for a visa/permit for her?
    This is all so confusing at the moment you have one person telling you something and another person saying no that is wrong!!!

    Really could use some straight advice.

    FYI I am a French national who has lived in UK now for 15 years, my fiance is a Kenyan national. She was in UK for almost 5 years, working etc etc. Our accomodation is no problem as we have just signed another contract but she was removed shortly thereafter.

    How long she overstayed?


    Once married I would advise you to prepare as many documents as possible.Your bank statments,payslips,letter from your employer,letter of support from you,photos of you two,cards...everything you can think of.
    You should apply for a family permit.

    She shouldn`t have a problems geting a family permit but....anything is possible.

    She overstayed for about 1 year I think. Now do I apply in her country for the family permit or do I come back to the UK and apply from here?

    I have spoke to some solicitors about this and get different advice but one seemed to think that by applying via EU route after we are married is better. He was aware of all the facts and said as long as we were honest and did not try to hide anything there was a very good chance it would be okay, but then like all things in life nothing is certain except death and taxes ;) , still it is amazing how many solicitors want money and more money, I am trying to do this without the use of a solicitor, but if eventually it comes to the point where I will need to use one I'll have to bite the bullet and hire one!!!

    Yes be honest and provide lots of documents.
    Use solicitor only in the case of refusal....but we better dont talk about that at this stage. ;)

    Sorry to trouble you again would that be application form VAF1 we fill out? If so do I also need to fill one out as well?

    Well all went well. just got the news my wife has got her permit. All went smoothly at embassy in kenya. Now just gotta wait to get her on the plane. Thanks for all your help
