    Just to say my wife was finally offered a visa a couple of weeks ago. They admit they made a mistake, though they still don't agree the application should have been free. The change seems to have been the result of my formal complaint directly to the Danes, rather than through SOLVIT, who don't seem to have much influence at all.

    I am an EEA citizen and need someone to please advise of the best schengen country to apply for a schengen Visa for my non EEA spouse going with me on a summer visit. I mean The country that respect the european law the most and recognise a genuine relationship. I have options in France,Greece and Spain.

    I'll be grateful for your advise.Thanks

    I'd say France, but it may vary from embassy to embassy. The French can be quite strict about the proof of marriage - you may have to have your marriage certificate translated and notarized or certified in the country it was issued in.

    Just contact the relevant embassies in your country for information. Watch out for ones that have long processing times. Big countries are usually better for this, as smaller ones sometimes send applications back to their home countries.

    Don't even think about applying at a Danish Embassy. They are breathtakingly unaware of EU legislation.

    Hi there Brendan
    your case is an exact mirror for me. I am British married to a Chinese living in Switzerland (go figure) and we want to go around EU thi summer. She has lived and worked in Germany, Swiss, Sweden and Greece over the last 5 years but i cannot seem to understand how to get her theSchengen. As i am an EU citezen, i am encouraged to see that she should be entitled to one as she accompanies me. Can anyone confirm that this is the reality?

    Under DIRECTIVE 2004/38/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 29 April 2004 Article 5.
    "2. Family members who are not nationals of a Member State shall only be required to have an
    entry visa in accordance with Regulation (EC) No 539/2001 or, where appropriate, with national
    law. For the purposes of this Directive, possession of the valid residence card referred to in
    Article 10 shall exempt such family members from the visa requirement.
    Member States shall grant such persons every facility to obtain the necessary visas. Such visas
    shall be issued free of charge as soon as possible and on the basis of an accelerated procedure. "

    I am contesting a case with the dutch government right now after my wife was charged by them for a schengen visa. i'll let you know....

    they are giving me a refund also they have been told to change the information on the website (consulate website)

    schengen visa's are free for EU family members.... :D


    hope to post a link soon to the ombudsman's decision....

    Hello,

    I know you are talking about a tourism visa, but maybe you can also help me in something else. I am Brazilian and my partner is British. We currently live in Brazil, and we are planning to live in Spain. She doesn't need a visa to enter or work in Spain, as I understand it. But I believe I need a visa to have residence in the country, and work there.

    So, my question is: what kind of visa do I need? What kind of document do I have to present? (Brazilian documents?)

    The last problem is: we are a same-sex couple and our marriage is not legal in Brazil. (We registered a domestic partnership).

    I greatly appreciate any help.
