✎ EN EEA 1+2 and EEA family permit

    Hi!

    I'm German living in the UK as a student, my husband is american and came in on an EEA Family permit. Everything great so far. Now, his permit expires end of september, and we were going to send off EEA 1 and 2 this week. However, their website says they are now processing EEA2 applications that were received in Febuary!!! We would like to travel for Christmas, and are afraid we won't get our passports back in time. So
    Question 1: do these applications really take that long? I don't anticipate any problems since our parents are underwriting us financially, so there shouldn't be any doubt as to our economic self-sufficiency.

    Question 2: can we, instead of getting the residence card, just apply for another EEA family permit, so that he can get back into the country (with me) when we return after christmas? Is this legaL? And is it possible to get an EEA Family permit if you're already in the UK on a previous permit?

    Thanks so much, this forum was my salvation when i was trying to figure out how he could join me in the UK in the first place!!!

    one more question: When it asks for home office reference numbers of previous applications... my husband applied for his student visa (a while back) and EEA family permit at a british embassy in the US - will he have a home office reference for those applications?

    about ho reference yes he should have for both
    and about waiting time it seems very long when you look at home office website
    BUT for us it was done in 3weeks1/2 we sent EEA1&2 on 24/6 and received back on 19/07 so i hope for u it will be as quick as us

    When applying for things like these, always expect the worse with UK government offices. THe other post here saying they got it in a few weeks time is an exception rather than the norm. What's normal is it takes a few months for the to process anything. You will soon find out that there is a lot of red tape in UK, or bureaucracy, and it takes time to have things done here.

    As for travel, when you are applying for residence permits/stamps, try not to plan travel with these hanging in the balance. Do your travel either before the current permit expires, or after you get back your permits and passports.

    Better safe than sorry.

    Hi,
    I'm colombian and my husband is french, I came to the UK with a EEA family member permit, when it was about to expire (end of march) we send everything to ask for a further leave to remain (not EEA2 don't ask me why it just seemed the right application for me, now I have my doubts) anyway they said it was going to take up to 14 weeks, that was end of june, at that time I called them to have news about my application they said it could take 3 more months that will be the end of september. I'm so upset, my husband and son are with my family in Colombia having a great time while I'm trapped here.
    I have not idea why it's taking so long, he have been married for 6 years, we have one son, good bank references so there is not any doubt about our economic self-sufficiency...everything... The first thing I'm going to do once I have my passport back is to ask for the french nationality.
    So, my advice is to ask for EEA1&2
    One more thing, don't believe what they said in the website... for the application I made they say, they are procesing june applications mine was made in march!!!

    EEA FAMILY PERMIT IRISH&JAMAICAN

    hi i am an irish Citizen living in the UK, and marrying my JAMAICAN fiance in 4 weeks, we have tried so many ways to get him to even have a holiday in the UK, but the BHK in Kingston, so far have refused, we appealed the working holiday decision of a refusal, we appealed in Feb 2005 and our case has not been heard - i recently got a letter from the Appeals Tribunal, who said they have now set a date sept 6th 2006 ( after 17mths!! ridicolous!!) - but now we cant go to that appeal, as we are now getting married- and he cannot get a working holiday visa, unless he is single-

    so my new worries are:

    IS IT HARD TO GET A EEA FAMILY MEMBER PERMIT?
    HOW LONG WILL IT TAKE?
    WILL THEY INTERVIEW ME AND HIM??

    i live and work in the UK, for the past year ?

    anyone got any advice for me please????

    my understanding is that as long as you can prove you are exercising treaty rights as an eu citizen (ie working) in the UK, and that you have enough money to support both of you, and that you have a place to live suitable for a couple, then your husband has the right to come to the UK with you and will get a family permit. (unless it's a marriage of convenience, ie. for immirgatiom purposes)

    apply at the british consulate in his country of residence. You will need your marriage licence and proof of the things i said above. It will take up to 6 weeks (at least that was the time in the USA), so you'll have to have a bit of time after your marriage. (my husband and i got married a few weeks earlier in a civil court so we had the licence to apply so that he would have his passport back in time for us to go on honeymoom after our church wedding)
