    hi guys im north african and i,m been living in uk for 8 years ligally i married eeu national from france im compliting 4 years marriage this june. i,ve got in 2003 2 years resident permit cuz my wife she was stading and working part time .i applyed again in 2005 then i,get 5 years resident permit will expire in 2010. so my wife she whant back to france for good and she asked me to move with her i,m refusing this adea for sure .so she asked me to choose between divorce and moving to france and i,have to choose divorce. so thats make me losse my resident or not .if not its any chance to apply in 2008 when i,complite 10 years leglation to make aplication to get (ilr)???? plz help

    You can apply for ILR if you have been living 10 years lawfuly in the UK.


    What kind of visa did you have before the marriage?

    loosing my right

    i,was asylum from 1998 untill 2002 i,got married then they gave my resident permit and my asylum case be refused.

    You have to be specific.
    You arrived `98 and you applied as refugee.
    Were you in the country illegaly?

    loosing my right

    i,applyed for asylum in port when i arrived they release me and they gave me temporary to stay till 2002 i,get married my eeu been granted and asylum refused. so from 1998 i,was living ligally guz they gave me right to work with national insurance number and i,ve got right for benifts also you get me? thanks for your help

    I would advice you to speak to legal adviser as well nearer the time as you`d be divorced in the time of your application.
    I am not sure you could apply for ILR.

    P.S. I have seen your post on another forum and the advice you got there is just about right.There you can get more specific information concerning your case.
    I did not see you mentioned your upcoming divorce thought.

    my friend was in france when he come back he left his wife in france and in airport immigration officer ask him for his eeu wife he said she,s in france .so he told him to get back and bring her . i,dont understan he got 5 years visa but he dont allowed him to enter with out his franch wife!!! any idea why and immigration office if he got right to do that?????

    As I always said Family permit/EU residence permit gives you right to enter the country.EU partner should be either with you or reside in the country that you are entering.

    i,get you but she was in holiday and off course she,s got resident permit to she just went for while to see her family.
