The poster if is to move to Spain can not ask for EU permit,her spouse is Spanish therefore national law would apply.
She can not apply from the UK because she does not reside there.
She has to go to Nigeria and apply from there.
If her husband lives and works in the UK she could apply for Family permit for UK,from her country of residence.
Within the UK you apply for a residence,therefore delays.

I'd echo that, not only is it possible that the person with the original query hasn't yet been sorted out given the pace that visa processing moves at, these threads are often used as a source of reference for the world at large.

I know that one thread started well over a year ago on a different forum by an American married to a Belgian living in France trying to get a visa for her mother still gets postings asking for further clarification from those in similar but slightly different situations (and those "slight" differences can make a world of difference in visa/residence permit applications).

There is Polish citizenship thread that has been going for a while,year or so,EEA waiting times as well.

People can post when they wish , with delays as long there is relevance to the case.

You can not avoid it if you wish to live in the UK.

The original poster had gotten married in the UK to a Spanish guy and she wanted to live in Spain with him. The UK wouldn't give her an EEA permit because her husband wasn't resident there, and the Spanish Embassy in London were saying she needed one to apply from the UK. It would be easier to leave the EU and apply to the Spanish Embassy in her home country.

 

Thats all fine but I am not sure its easy.May take months for settlement/marriage visa.

 

I concur that this thread has significant relevance even if it has taken a few months to be clarified,what the moderator doesnt quite understand and ,Rhea cannot really blame him for this, is that for it is quite nightmarish for Non Caucasian spouses or family members of EU citizens to get their rights(if any)enforced,

It would seem unthinkable to you that a a country such as France would have personell who would bar as in restrain a spouse of an EU citizen the right to even make an application for no conceivable reason(LAW SUIT IN THE OFFING!),as in NONE!When I hear some people say they got their EEA Family permits in one to three days,what becomes apparent is they must not be people of colour(in most cases),rules state that you must get your data from the embassies by telephoning or email but its hurriedly given,invariably incomplete and booby trapped to give you the greatest inconvenience possible so any and all information is sorely needed.

The originator of this thread is looking for the minutest detail pertinent to the case cos the E.U laws are not broadly interpretred for all people and this Sir,is a fact of life,my regards!You are doing an exemplary job,all of you.

P.S:TO WHOM IT MAY CONCERN,IRELAND IS WHAT THE U.K WAS DECADES AGO,FREINDLY,TOLERANT AND A STICKLER FOR THE RULES,BEAURACRACY TAKES FOREVER BUT ONCE YOU GET OVER THAT,YOU WILL BE ALRIGHT.

 

To be honest, I don't see much racism in the system, just incompetence. My wife is white and european (buy non-EEA), yet every bit of paper still takes months to get.

 

I don't know that it's racist per se but there are some countries who seem to have something of an obstacle course to get visas of any kind. We run a little hotel in France and find that significant numbers of South Africans (white and coloured) need to cancel their reservation as they can't get a visa to come here even for a week.

Because of where I used to work, I was able to get phone numbers of the people dealing with Wendy's case and even then it took us two months to get the EEA residence permit in the UK. I got the impression that it was simply down to the sheer level of work as we were initially told that the permit would be back in a few weeks.

The originator of this thread can not exercise the EU law because of her specific situation.
The law she falls into is a Spanish marriage/settlement law.

National laws still exist and EU laws can only be applied if people do move countries or intend to.
