✎ EN UK Fiancee Visa stuck in the mud?

    I am a Canadian citizen and met my UK fiance about 3 years ago. I applied (in Canada) for a fiancee visa so that we could get married in the UK; that was in November 2005. In December '05 I received a letter from the British High Commission in Ottawa saying they wanted more information, one of which was proof that a wedding was being planned. My lawyer faxed this additional information (including the information from the Registrar's Office in the UK with the wedding date clearly stated), on January 6/06. The BHC's website says that the application would be done within 20 working days after receiving the additional info. Well, here we are almost at the end of February and I still haven't heard anything. Not only that, but now it's too late for me to get a fiancee visa in time to make my own wedding date! (it was slated for March 13th).Surely they know of the 21 days requirement and know I won't make it now. I almost get the feeling they've lost my application! My UK fiance is a tetraplegic and therefore on benefits; but I have given the BHC proof of enough of my own money; this shouldn't make a difference if he is a disabled person, should it? We are both in our 50's; not young. We've known eachother for 3 years, have taken holidays together and we've visited eachother almost every 3-5 months within that time. Why is it taking so long when they say it would be completed within 20 days? I feel like withdrawing my app. and marrying here in Canada and returning to the UK with him for 6 months (leaving for a month) then returning for another 6 months if that's the only way to be together. Please, please help! Any information would be welcome.

    I would like to help you but, I just do not know.
    My gut feeling is that your application is still pending and for some reason they asked for some clarification from London.

    Hello, Triple H. I didn't think that it could have been handed over to London for consideration. If that is the case, it will no doubt be many months before anything is decided :( Thank you for your insight.

    "Deferring applications for further documentary evidence can be time consuming for both entry clearance staff and for the applicants. At times, applicants may have to make repeat visits to the visa section. Wherever possible, applications should be decided at the time they are submitted. To assist in this process, it is important that applications are submitted complete with the appropriate supporting documents.

    Posts should provide sufficient information (by publicising on websites, notice boards, telephone enquiry point, etc.) to ensure applicants are aware of the requirements. They should also make it clear that the ECO will aim to resolve the application on on the day it is lodged, on the basis of the documents produced at that time.

    There may be circumstances where it is appropriate to defer applications for further information. This may be to other Posts, the Home Office, or in order to check arrangements in the UK.

    If you think that the nature of the information required means that the application will require referral for a decision in London, you should do so at the start."
