✎ EN Non EU family visitor "to work or not to work"

    Hi Every1

    I was hoping that some1 could give me some advise in regards to going to the UK as a non eu family member visitor.

    1stly and most importantly, am I allowed to work if my wife is an EU member who is working in the UK and I go there as her husband but I enter as a non eu family visitor instead of with an EU Family Permit?

    Secondly, I do not need to obtain any kind of entry clearance prior to going if I go to the UK in this capacity. This means that I just have to satisfy the Immigration Officer at the port of entry, but do I have to provide evidence of sufficient funds to do so?

    I would appreciate your help!

    If you want to work, you should try to get the EEA family member permit, rather than entering the UK as a vistor. As a visitor, they will probably stamp your passport saying you are not allowed to work. Nevertheless, under European law, you are definitely allowed to work whatever it says in your passport as long as your spouse has employment. But an employer might not like seeing that stamp in your passport, so it just complicates things for you.

    I did find information on the internet saying that I can work if I enter as a visitor but might have problems proving this to a potential employer.

    OK, now what? Surely they must have thought of some way to prove this, otherwise, how do people in my situation find a job while they are in the UK?

    I know that it would be the better option to get a permit instead but my circumstances prevents me from doing this, otherwise I would do that.

    Do you have any advice for me or do you know where I could get a factual answer for this question?

    I have been worried about proving my right to work as well, but I have the EEA family permit, and found this website listed by someone else on the forum, which states that the EEA family permit will serve to prove right to work:

    Your situation will be more difficult... I don't have an answer and maybe someone else will.

    In a previous reply you said circumstances prevent you from applying for an EEA Family Permit. Kindly state whatever hindrances you "think" makes it quite hard for you to get the Family Permit. Lack of information in this scenario is what will prevent me from giving you sound advice, of whcih you are seeking.

    I did study the info on the site that you gave me and it looks like I would have to phone or email some1 for an answer as I couldn't find it.
    But thanx anyway and I will let you know how it pans-out.

    Polskasweetie, the reason I cant get the permit is because I'm not in my home country at the moment and won't be able to go there to get one. I know that under EU law I should be allowed to work but I have to find out how I can prove this.

    My wife is also Polish and she will be going to the UK on the 5th of Oct. I will join her one month later as she needs time to register and get all the necassery docs I need to enter the UK.

    Perhaps you know how long it takes for A8 nationals to recieve their WRS details and if she has to have it before I'm allowed to work?

    Anyway, hopefully I'll have some answers next week and I'll be back if I have anymore questions as I know that you and your husband have studied this topic quite intensely!

    You may not be in your home country, but that doesn't mean you cannot apply for the EEA Family Permit from whatever country you're in right now. The EEA FAmily Permit can be applied at the nearest UK Embassy of the country where you currently are, as long as you have a legal right to be in that country (i.e not being an illegal alien), then you shold be fine with applying for the said permit wherever you are.

    Second, you didn't mention what your nationality is, so we can paint a better picture of your situation and properly advise you.

    Third, assuming you're not an EU National, and the country where you are now, you are legally there (with a valid permit/visa), then while you and your wife are together, I strongly suggest you apply for the EEA FAmily Permit already, as one of the requirements you need to submit is your wife's passport. Check the other topics here as I've listed EXACTLY what documents you need to get that EEA Family Permit. You can go to this one and scroll down where I mention the requirements.

    Hi!

    Ok. Maybe I did something wrong when I sent it cause I'm still new to the forum. Never mind.

    Listen, I spoke with my wife and we opted to get the permit cause it might be easier. Now, I've been trying to get info from the UK Embassy in my country (South Africa) as to how long it will take to process this application and you won't believe the stupidity in that place!

    Anyway, we would appreciate your advice in doing this if you feel like ofcourse. I know that you're probably tired of this topic already :D

    So I will let you know what they say when I hear from them.

    Hi Polskasweetie!

    Listen, I got an email 2day from BHC in SA. I asked them how long it will take to process an EU family permit appl. and they said, " We aim to issue all visas on the same day of appl. " That is great!

    In a previous email they told me that I won't be able 2 do it through the mail and that I have to be present in SA when I apply. But I would like to be sure about this before I go back, otherwise I could do it from PL.

    So I'll check that but in the meantime I would like to discuss my appl. with you. I know what I need according to your earlier postings but we have a few questions. Does my wife need her WRS card and certificate, in other words, does she have to be regitered before I can apply?

    I mean , what exactly do I need from her side to do this? I'm sure you know what I'm talking about :?:

    To get the EEA Family Permit, I'm sure you've seen my other post where i detail everything you need from your spouse. Her WRS card and documentation is not needed, as the EEA Family Permit is not dependent on the EU citizen actually being employed already in the UK or not. Remember when I applied for my EEA Family Permit, my wife was in the US with me, no WRS, no UK tenancy agreement, no UK pay slips to show. What I listed down in the other thread is what you need to give to the UK EMbassy, either in SA or PL, but if they say they can do it in a day, then good for you. The thing is, there's actually no reason for offices to delay the release of the EEA Family Permit other than pure bureaucracy and red tape and laziness. They only need to verify identities, that the papers submitted are not forged and are genuine, and then that should do it.

    What you need from her is her passport, a letter requesting the embassy to grant you that EEA Family Permit, bank docs from her if you can, but more from you. Bank docs from both would be better, to show that you guys are not gonna be a burden on UK Government. You don't even have to show you have alot of money, but that you HAVE money period.

    Correction: I AM polskasweetie! I'm the husband of aleks721, if that's what you're wondering about. As for your letter, kindly give another member here, technospirit, a private message regarding this, as I sent him a pm with a sample letter. Just fill in the blanks where it is appropriate in your case.

    I just wanted to say thanx 4 all your help, we really appreciate it. This forum has made life a lot less complicating 4 me and I'm sure 4 many others.

    I have now obtained all the necessary info and advice that I will need to make my application and will disappear 4 a while as I want to set the ball rolling :)
