    Hi everyone,

    I am new here, so first let me introduce myself. I am a 40 yo Dutch national, married to a Thai wife (for Thai law). We’ve lived together in Thailand for almost 4 years and have 1 daughter (also Dutch national) age 2. For several reasons (mainly financial) we decided to leave Thailand and move to Europe in April 2005. My wife went with me to Holland on a tourist (Schengen) visa, but had to go back to Thailand after 90 days. My daughter is living with me. We are now planning to move to the UK and work and live there. At the moment I am still in Holland.

    Can anyone advice me on the following. As I understand, my wife needs to apply for an EEA family permit in Bangkok, Thailand. Our marriage is registered in Holland, and my wife has all the relevant Thai documents (birth certificates, marriage registration etc.) translated and legalised with her in Thailand. I have the following questions (so far):

    How long will it take to process the EEA family permit application (in Thailand) and how long will it take for her to be allowed to travel to the UK? (she also has family, an uncle, living in the UK)
    Does UK immigration need any proof of income (from me) during this application?
    Do I need to live in the UK during this application?
    The Thai marriage, already verified in Holland that it is not a marriage of convenience, is that sufficient for the EEA family permit?

    I would be very grateful for any help or advice, although I know I am asking lots of questions. The main reason for these questions is that I am now 24/7 mum and dad for our daughter and the way things are in Holland that situation can last months and months (which is a long time for a toddler to be without her mother, and vice versa). We just wish to be reunited as soon as possible, so that we can start our new life, preferably in the UK.

    Just read your post here, and it breaks my heart to know that your family is apart, just because of visa reasons. My wife (EEA National) and I (non-EEA) just arrived in UK about 3 weeks ago from the US and had to go through the same paperwork to get the Family Permit in my passport. Anyway, here are your steps to get that for your wife.

    1. Your wife has to fill out VAF1 form to apply for the Family Permit.

    2. She needs to attach financial documents to prove that she will not be a publuc charge to the UK Government. If she is employed in Thailand, then she can request an employment certification from her employer, stating that she is employed in (company name) and her position, start date, and salary information. If she has bank accounts in Thailand, she can request the branch manager of her bank to give her a letter certifying that she has an account or has several accounts (whichever is applicable) in the bank and that the accounts have been maintained in a satisfactory manner. If she is not employed, then you will have to send her your financial documents to show that you are supporting her.

    3. Then she will need a certified true copy of your marriage license/certificate as proof of the marriage.

    4. She will need her passport and your passport (to prove the identity of the EU National).

    5. Then you have to write a letter addressed to the UK Embassy in Thailand requesting the EEA Family Permit for your wife. Restate the facts that you are married, how long, that the documents to prove such are attached in the application, and that she will not be a public charge to the UK Government as she has enough funds to support her stay and/or you are supporting her as well. Mention in the letter that you both of you have a child, and the main reason why you want the permit is for your family to be together (whether in UK, Holland, or elsewhere).

    6. She will need to passport sized color photos (45mm x 35mm) on plain or white background. Make her sign her name at the back of the photos.

    7. All of the above, plus another envelope (prepaid to be returned to your wife from the Embassy that would include all the docs she submitted), should now be mailed via UPS or FedEx to the UK Embassy in Thailand. Have her choose the signature option so that it will be recorded that someone signed at the embassy to receive your docs.

    How long it will take to process this depends on the red tape of each country. Mine only took about 5 business days. Hope this helps Remi. Let me know if you have any other queries.
