    Greetings!

    As my name suggests, I am an American in Finland wanting to marry an Estonian (living in Estonia). As with everything across boarders, it seems it is not an easy proposition! What are the rules for a non-eu person to marry a soon-to-be eu person from Estonia and live in a eu country?

    Hey! I hear your problem man. Im actually in the same exact position with a finnish girl... If you hear any good info pass it along! maybe when i get back to helsinki we can get together for a pint. Good luck mate.

    Hi,
    First of all, the general rule is that when you marry a EU person, you get the same rights than this person. Therefore if you marry a Finnish person, and you want to live in France for example, you will not need a visa and other such papers to find a job. Your ID will be enough (and depending on the country you might have to apply for a resident permit but that's just an admin process). Anyway you are strongly advised to sort out all the papers to become EU citizen before in the country that your EU partner is from.

    For Estonia, unfortunatly it's a bit more tricky! Yes they will become part of the EU next year. But first they are not part of the Schengen area where you even do not need ID to circulate, but also other older EU country are thinking about applying some restriction to welcome the Eastern Europe population (see Holland for example that wants to limit to 22000 per year the new EU citizens to come).

    So anyway, the first thing to do is take information with the consulate...

    i am a bangladeshi citizen applying for students visa in australia.
    i have got one problem.
    i visited the USA 2 months ago on US immigration visa, but over there i was charged of a crime-of domestic violence, and there is a warrant for arrest outstanding in that country for me.
    i wanted to know whether i will have any problems.

    There again Cyril, your reply is misleading. If a non-EU citizen marries an Estonian in Estonia, he or she doesn't automatically acquire EU rights. For the purposes of immigration he or she would be dealt with under Estonian Immigration Laws.

    He will only acquire EU rights, if his Estonian/EU partner takes advantage of an EU Treaty (eg Freedom of Movement) to move to another EU country for economic purposes.

    The rights cannot be estblihed if one has not moved from his/or her country. So in the case of David, the only way by which he can derive any benefit from the rights is if, the wife seeks employment in the UK or another EU country.

    The bottom line is that the right is not automatic. Even thought he may be married to an Estonian/EU partner the right can only initially be exercised by the EU partner through an Economic Treaty. There and then will he has access to the Rights.

    Thanks again for you information here.
    I think part of the reason why things seem a bit confusing, is because they are very complicated :shy:

    Basically, I would say that the general rules when you marry a EU citizen are:
    -> you can acquire the nationality of your EU partner according to the immigration rules of your partner's country;
    -> you inheritate from the EU rights of your partner in other EU countries according the European Union treaty.

    Feel free to correct me if I've misunderstood the rules or if my explanation needs to be more accurate.
