    i m non EEA family member of an EEA national.if i have baby in 6 or 7 months time.whats going to be her immigration status.i m dependant on my father living with him but i m over 21 though.

    So if you are settled in the UK, the child may be eligible to UK citizenship, provided the father is a UK/EEA national or a permanent resident in the UK. I understand "settled" to mean married to an EEA national with a residence permit, or otherwise with indefinite leave to remain, but my understanding is not thorough. You may also find a call to the UK Immigration and Nationality Directorate useful: 0845 010 5200

    as i discribed i m on non EEA family permit depending on my EEA national father i do not think that i av got settled status in uk.my partner is on overseas student visa with limited leave to remain in uk.ane more infomation regarding baby status.

    In order for the child to be able to to get UK citizenship, one of the parents should have a settled status in UK i.e Permanent Residence. In your case, both you and your spouse are subject to immigration control i.e with a limited leave to remain so the child is not eligible for UK citizenship. Just because you are dependent on your EEA national father doesn't give your child the right to UK citizenship. The child can either become a national of your country or that of his/her mother or maybe both if your countries allow dual citizenship. You can find it out from your embassies.

    just wonder that grandchildren of an EEA national can comes under the extended family members.can ours baby not comes under this catogery i mean extended family of my EEA national father.

    I am sorry I didn't mention it in my earlier reply coz I thought you were only asking about your child's right to become UK citizen. Yes I guess you are right but I am not really sure if you can apply for your child in the extended family member's category or not, but a part of me says, Yes you can ! I would suggest you better see a solicitor regarding this matter who would advice according to the current legislation OR ( if you are not in a mood to pay the solicitor ) alternatively, you could seek advice from the Europe Direct. You can either give them a call on 00800 6 7 8 9 10 11 which is a totally free number ( not from a mobile ! ) OR you can go to their webpage

    to send them an e-mail OR chat to an on-line available advisor.
