    hi
    i had a question my sister wants to get married and her residence status is residence card for 5 years dependant on her eea father,but she her self is non eea.so i wanted to know does she need coa approval or since she is non eea family member of eea national this makes her not needy for coa approval thnx so much.we are really confused.

    Yes she needs a COA from the Home Office because she is not a British/EEA national nor has she a permanent residence for UK. Just because she is dependent on EEA national doesn't exempt her from COA.

    If you are a British citizen, a national of a country in the European Economic Area (EEA) or the family member of a national in the EEA who is not themselves an EEA national, but has a right of residence in the United Kingdom, have a certificate of entitlement giving you right of abode in the United Kingdom in your passport, or are not subject to immigration control, the rules on certificate of approval do not apply to you.



    so does that mean that if ur family member of an eea and u ur self is non eea but have the right to reside in the uk than u dont need coa approval??

    The portion of legislation that you highlated says the 'right of residence' but it doesn't mention if this right of residence should be permanent or not. I have never come across such a situaiton so I am afraid I won't be able to advice anything. You however don't need to be confused. You can simply visit or call your local Citizens Advice Beurea or Law Cantre. They will be happy to confirm it. You can also wait for more replies here on this forum but that might take time.
