Re: APPLYING FOR EEA 1 & EEA2 RESIDENCE CARD NEED ADVICE

    1. See here http://www.bia.homeoffice.gov.uk/eucitizens/applyingundereuropeanlaw/
    2. In theory it should, but a large number of us have found it difficult convincing prospective employers of our rights to work with just the Certificate of Application (acknowledgment letter). You may want to hold on to your passport (if you still have a valid visa in it) and only send a certified photocopy to the HO. A caseworker would normally request that the original be sent when your application is being dealt with.
    3. Based on the feedback from previous applicants and those still waiting (like myself) it can take 6 months and beyond.
    4. Your EEA spouse can apply in person at Croydon (but appointments are booked up for the next 2 months). You can only apply via post.
    5. After 5 years you can apply for permanent residency as long as your EEA spouse has been exercising a treaty right continuously for the 5 year period and you have not been outside the UK for more than a period of time over the 5 year period. After 5 years + I year of PR you can then apply for naturalisation (after taking the Life in the UK test). The 5.5 years you have spent on your student visa does not count towards permanent residency under EEA law but counts towards 10 year long residency under UK immigration law.

See the HO site for all the necessary info on EEA residency and settlement in the UK http://www.bia.homeoffice.gov.uk/eucitizens/

    Hope this helps

What do you mean by your spouse would be completing her 1 year residency on the 10th of Sept? Is it permanent residency?

Re: APPLYING FOR EEA 1 & EEA2 RESIDENCE CARD NEED ADVICE

Oh I see... Well in that case you won't be able to apply for an EEA2 until she completes her 1 year WRS. Your spouse would also be able to apply for residency using EEA1 route. Remember that submitting your applications together may not speed up the process as such applications now need to be submitted to two separate places. You could try submitting both applications together but it's most likely that yours would be sent to Liverpool anyway.

Please refer to the BIA links above for more info on this.
