    HI... i´m sorry to cause you any trouble, i´ve been reading all the posts for like an hour but i still have some doubts...

    Im Argentinean (non-EU) and i´m planning to go to uk to get married with my Spanish girlfriend who is living there... i didn´t have enough time and money to apply for a fiancee visa so i´m goingwith a leave to enter (tourist) visa... She did her little research over there and went to the Spanish consulate and they told her that after we got married and we registered the marriage there they would give her "libro de familia" and that i would get immidiately my residency in uk and work permit...

    After reading lots of webpages i´m not so sure about it...

    Could you tell me in a first place if it´s going to be possible for us to get married in england? I´m thinking we might have to go to spain if we cant. She has been told at the register office that i have to live with her 7 days, and that i have to register myself as soon as i get there... and after 7 days we can apply for a marriage wich will take place 15 days afterwards... Is anything ímportant i´m missing?

    But we want to live in england, so, will i be able to go from visitor visa to some kind of residency and work permit taking in account i´ll be applying from inside the uk?

    What should i do?

    I´m sorry to ask a question thats been asked before but im quite confused now...

    When you say my Spanish girlfriend who is living there... does that mean UK? If she is a UK resident she won't have any problem to marry in England. However even if she is not UK resident, the rule is that you have to be living in UK for 7 days before to apply (as you've been told). You will have to go to the council house to fill the forms for the ceremony.
    After you get married, you will receive your marriage certificate, which should allow you to the same right as your partner (however you might have some delays if the Spanish authorities require let say 6 months to validate the new status).

    Your visa has nothing to do with being in the UK or not, but more about being married with a EU citizen.

    Hi, thank you very much for answering my questions....

    And yes, i meant she is living in the uk right now, she's been living in UK for more than 5 years now, and i think she is a resident since she has her london address in her spanish passport... i'll ask her about it...

    About the seven days... i'm guessing that showing my passport is enough to prove that i've been in uk for more than seven days, if not, how can i prove it?

    And just in case...

    I've been at the British Embassy and they told me that if i get married in UK with out a fiancee visa i will have to come back to Argentina to apply for a spouse visa... and after that i could go back to UK and that i'll have all the rights as my partner

    So what you said about waiting for the spanish authorities to validate our new status as a married couple...

    Does that means that i have to wait until it's validated by spanish authorities before i can aply for my spouse visa? or is the marriage certificate by itself enough?

    I answered a relativily similar question in another topic here, regarding the 7 days period. Therefore, it shouldn't be a problem.

    Regarding the second question quoted here above, it's only a question of time. As I am not an expert in immigration question, you should ask for confirmation with consulates. However I see 2 possibilities:
    1- You go back to Argentina and apply for a Spouse Visa (or Fiance visa before the departure)
    2- You ask to become a Spanish citizen and therefore need to follow the rules of the Spanish immigration (especially in term of delays). But several questions araise: will you be able to renew your tourist visa in UK if it takes more than 3 months (it could be 1 year, I can't remember)? Will you need to go to Spain before you come back to England with your new status? ...

    One thing is sure, once you are Spanish (if you ask) you do not need a visa anymore within the EU!

    PS: regarding your second message, I think I deleted my previous answer, a duplicated answer by mistake .. that's why you got the message warning you of an answer.

    Under EU Law once you are married and your partner is with you ,you don't have to go back to your country for a partner permit. As long as your EU partner is working you can just forward your request for EU Residence Card to the Home Office.
