just wanted to share a recent success in eea3 & 4 applications. Me (eu) and my husband (non-eu) applied in october 2009, received enquiry letter in march 2010 stating that i need to provide 'comprehensive medical insurance' as they classed me as a student. Although, i am postgrad student, i was always working. As i didn't have any insurance for those 5+ years, i had no choice but try to convince them to class me as a worker. And it worked!!! I send them my payslips + nhs medical cards with covering letter saying that as a tax payer i'm eligible for nhs cover.
My advice to everyone: don't give up whatever they ask for! Make your case why your nhs cover is valid or a proof that you didn't use nhs. I think even if you are a student and didn't work, get any medical insurance just to show something. Of course, it depends on a caseworker, but it seems they're trying to be difficult at the moment so don't let them put you down. If you lived here long enough, you have a right as well!
