    How to set up an LLC in China?

    Hi Friends,

    Foreign entrepreneurs are increasingly setting up new businesses in China to take advantage of China's booming and rapidly expanding economy. The legal entity of a Limited Liability Company (LLC) in China may be either registered as a Joint Venture (JV) or a Wholly Foreign Owned Enterprise (WFOE). As I want to set up an LLC in China, I want to know about its procedures and regulations governing both types of enterprises is often a long and complex procedure. Can anyone have an idea on it, please help!

    Well, the first question would be if you speak Chinese and even if you do I would recommend using one of the many companies here that help foreigners to set up and manage their companies in China. If you need a recommendation, let me know.

    Have you contemplated doing business or are you a business owner in China?

    Are foreign investors welcome? How hard is it to register and manage a company? What is the procedure to get started? Is it easy to recruit? What are the corporate tax rates in China?

    What advice would you give to other prospective business owners? What do you wish you had known before opening a business in China?

    you will need an agency to help you with this. I do not think it is possible for a foreigner to do this by himself without help.

    Suggestions:
    - Use an agency.
    - Don't use a lawyer - they outsourced to an agency anyway.

    Depending on the type of business, it may not be complex at all. They help you with name search, incorporation, business license, tax licenses, etc.

    Choose an agency near the geographic location of your business, as they have better relationship with the tax office and commerce bureau in the area. That could save you hassle and money in applying for all the tax exception benefits you are entitled to.

    I would recommend only using an agency that someone you konw has done business with beforehand. There are some less than reliable people out there, as one of my friends recently just found out.
