✎ EN Fiancee visa worries

    ok this is how it is

    i got married to someone i met in india. i mer her when i was 15
    we met when we were 15 instantly liked each other :) , we kept in contact for 3 years always ringin and sendin letters, of course the family didn't mind.
    about 3 months ago i got engaged to her in india :D
    most ppl in india get married and come to england thats how her friend got here.
    i ain't got the time to go over and get married because i'm workin :confused:
    what i was hopin is she comes to england on a fiancee visa and settle here after gettin married (as in come to england as a fiancee, get married and stay perminantly in the uk)
    is that possible? o_O
    at the moment
    i have my own house
    i am workin full time and get a good decent wage
    i have kept the letters that i sent her and she sent me
    i have the engagement photo album
    i even have a picture of us when we were both 15
    i'm a uk citizen of course

    there shouldn't be any problems should there
    can she stay in the uk after marriage if she applys for a different visa
    if so whats the process wen does she need to send forms off and which ones i want to get as much information on this before i do anything here
    what i'm worried about is she comes to england on a fiancee visa and after marriage she can't stay and can't apply for another visa to stay and settle so she ends up going back to india i DON'T want that to happen

    Summary: you'll be fine with that application pack.

    When applying for the visa you will need:
    Notarised copy of your passport
    Original birth certificate (check with the embassy in India if they'll accept a notarised copy - it's a pain if they go missing)
    4 to 6 months pay slips
    4 to 6 months bank statements
    A copy of the title deed for your house (may need to be notarised, depending on the embassy)
    A letter from you explaining to the Entry Clearance Officer your history and relationship, future plans, accounts, etc.
    All your letters/emails/phone bills/photos for as far back as you have them. Highlight calls to her on the phone bill.

    She will need:
    Passport
    Birth Certificate
    6 months of her bank statements (I have no idea why. I strongly suspect our government is money-mad)
    Passport-style photograph less than 6 months old.

    All should be submitted together by her along with the fee in local currency equivalent of £260

    What that document didn't say is this:
    * When your fiancée arrives in England, she is on basically a 6 month tourist visa. Within that 6 months you have to marry.
    * Before she can declare her intent to marry, she must obtain a Certificate of Approval from the Home Office. This costs £135 and is subject to the caprice of civil servants. (Actually the linked doc did talk about this: mentioned it might be an illegal policy under UK law)
    * At the end of the 6 months she will have to return to India to apply for her visa as a spouse.

    In the end it might almost be easier for you to ask for a life-favour from your employer and take a couple of weeks off to tie the knot.
