hello everyone. I have been in a relationship for 10 years to an American citizen. We have 2 Canadian born children. He was living here illegally for 10 years, we have had many hardships and stress dealing with a corrupt system here in Canada. He was deported once. He hasn't had any ID in 16 years. He just went back to the states to get his ID and lisence and all that so we can try to move our family down there.
What I want to know is what is the best way to do it....should I get my kids dual citizenship before even going down? Should I go down as a visitor and then marry him? We are not legally married because he could never prove who he was. I have been reading about the K1 visa for fiancees....he has to apply for that though right? I can't do it?
I just want to know if you forsee any problems. We just want to be together and not have to live in fear we need to get on with our lives.

    thanks a lot

    after 10 years...

From what you say I don't know the specifics to really answer fully, but yes He has to apply for the k-1 visa, but no one prevents you from filling the paperwork and having him sign. Check the www.uscis.gov website it has useful ressources about visas.
I figure you want to avoid costly attorney fees, even though I can only recommend you at least take advice from one, I paid 120 US$ to talk to an immigration lawyer for a half an hour, and a friend spent 2,000 US$ on her green card application through a lawyer.
To start with, buy yourself a self help Nolo book about "marriage and fiancee visa applications", it's about 25 us $. Although done buy serious lawyers, it's written in a very straight forward fashion, no crazy jargon, and with concrete examples. You can check their site for more info and purchase at:

    Good luck!!
