    Hi there
    I met my fiance on holiday last April 2005 in Scotland. Since then I have returned to NZ and came back in October when he proposed. I have a 6 mth holiday visa which expires in April 2006 but we have been refused a Certificate of Approval because of the type of visa I am on. Is it easier for both of us to return and marry in NZ? We had hoped to marry here and return to live in NZ? Does anyone know of the forms we need to fill out and how much easier it is to take this avenue?

    Hi,

    If you intend to marry in the UK you would have to return to NZ and apply for Marriage Visitor ,as you do not intend to stay in the UK.


    "From 1 February 2005, non-EEA foreign nationals who are subject to UK immigration control who wish to marry in the United Kingdom will need to follow new procedures.

    They must either:

    Hold entry clearance as a fiancé(e) or marriage visitor, or

    Hold a Home Office certificate of approval, or

    Be a person with settled status in the UK (e.g. indefinite leave to remain)

    People who are subject to immigration control will also be required to give notice to marry to a registrar at one of a number of designated register offices throughout the UK. More information can be found on the Home Office website:

    Therefore, non-visa nationals (including New Zealand nationals) will no longer be allowed to enter the UK as a visitor and be able to get married there, unless they hold relevant prior entry clearance, a Home Office Certificate of approval or have settled status in the UK. This applies whether or not you intend to remain in the UK after the marriage has taken place."


    I have no knowledge of NZ rules.

    I have read if we reside in England for 7 days or more you do not require a Certificate of Approval if we intend to marry in the Anglican Church. We are both Anglican.
