✎ EN Polish visa rules how daft

    i cant just seem to get my head around this,ive just been on the polish uk consulate website and what they are basically saying is that if you are the non EEA spouse of an EEA national and have a valid residence card issued in the Uk as long as you travel with your spouse to poland you dont need to apply for a visa as long as you take your marriage certificate but if you are a non EEA national married to a Polish national you still need to apply for a visa
    how daft is that

    That is odd. Since the Surinder Singh case, even nationals can benefits from EU law under certain circumstances, and this seems to be a fitting example. So it may be worth asking about the details.

    Just noticed this.
    It is not daft at all, because it relates to the EEA basic right of exercising freedom of movement. A Polish citizen is not exercising freedom of movement while in Poland, so his non EEA spuse would be subject to Polish law, not EEA law.
    In fact,Poland is fairly relaxed about non EEA spouses members entering Poland as long as they are accompanying their EEA (but, not Polish spouse). A non EEA spouse can travel alone to join their EEA spouse by obtaining a (free) Family Permit simply and quickly from any Polish diplomatic post
    Anyone from the UK that thinks Poland is tough, should try getting a non EEA wife into the UK!
