    Hello a tous! (English version below)

    Laissez moi vous faire part de mon soucis:

    Je viens de diplomer en Decembre 2010 a NY, j'ai eu un BBA en Marketing. J ai ensuite enclenche mon OPT (qui a prit effet debut mars) et j'ai recu ma carte de travail en meme temps.

    Maintenant, mon OPT a expire, et ma carte d autorisation de travail expire en Fevrier 2012.

    J ai trouve un job il y a un mois, je n ai cependant pas encore signe de contrat. Ca se fera uniquement une fois que je ramenerai des clients.
    Ma question est la suivante:

    J ai entendu dire qu il me fallait 3 mois de salaire avant meme que j applique a l'H1B. Certains m ont dit que c etait faux, certains m ont dit que ce n etait pas necessaire, bien que recommande (dans l optique d accroitre mes chances d obtention du H1B), et certains m ont finalement dit que c'etait requis.


    C est ma question principale, mais dans le cas ou vous auriez des tuyaux et autres conseils, je suis plus que preneur.

    Egelement, on m a dit que quand bien meme j obtiendrai mon H1B, il ne serait pas effectif avant Octobre 2012..?

    Hi everyone,

    I am stuck in a very uncomfortable situation, let me explain you why.

    I graduated from Pace University in New York in December 2010. Therefore, I have a F1 Visa. I started my OPT in March 2011, I got both the employment authorization card and the OPT back then. Here's the thing:

    -The OPT lasts 3 months + 2 months grace period, meaning that by now, it has expired.
    -I found a job a month ago (early September), but I still dont have a contract. The company is in a rough position, so as soon as I bring customers in, I'll get a contract.
    -The job definitely requires someone with a BBA in marketing, which is what I got at Pace University.
    -If I bring customers in, they'll both pay me and sponsor me

    BUT

    -My employment authorization card expire in February 2011. Meaning I have not much time left
    -I heard that BEFORE I apply to the H1B, I need 3 months of salary. Is that true?


    I would like to know what you think about my situation, and what i should do. I went online, asked people around me, and I get lots of different (and contradictory) answers.. My main questions is whether the thing about getting paid during three months before I actually apply for the H1B is true. If it is not, it means I can try harder at the company i m working for. If not, I ll need to find another position very fast.

    Also, it seems that if I apply and get the H1B, it won t be effective before October 2012. Is that true?

    Looking over the official resource of Travel.State.gov H1B, it offers information on requirements:

    " Online Nonimmigrant Visa Electronic Application, Form DS-160. Visit our DS-160 webpage to learn more about the DS-160 online process.
    A passport valid for travel to the U.S. with a validity date of at least six months beyond the applicant's intended period of stay in the U.S. (unless country-specific agreements provide exemptions). If more than one person is included in the passport, each person desiring a visa must make an application.
    One (1) 2x2 photograph. See the required photo format explained in Photograph Requirements.
    Visa applicants included in L blanket petitions must provide Form I-129S, Nonimmigrant Petition Based on Blanket L Petition.

    Additional Information
    With the exception of the H-1B, L-1, and O categories, visa applicants also need to show proof of binding ties to a residence outside the United States which they have no intention of abandoning.
    No assurances regarding the issuance of visas can be given in advance. The approval of a petition does not guarantee visa issuance, as the applicant will need to be eligible for the visa under provisions of U.S. immigration laws.
    Final travel plans or the purchase of non-refundable tickets should not be made until a visa has been issued."

    I do not see a requirement of 3 months of salary.
