✎ EN Lastest news regarding my application under EU law!

    I recently write on this thread that I made an application as former spouse of an EEA national to retain my rights following the termination of our marriage which would have been 5 yrs aniversary today. I made the application early November 2008 using EEA2 application form because there is no special form for such application. At the time of the application I was 7 months away from my residence card expiring. The documents I submited was enormous,way exceeding the minimun requirements for such application. In all, our marriage lasted for more than 4yrs before my ex innitited the divorce proceedings, although it was after I submitted my application to the HO because my ex was threatning of notifying Ho that our union has broken down that i received divorce proceedings which i forwarded to HO and subsiquently ,I sent them decree nisi and last month the absolute was finalised, so I also sent them.To my greatest suprise, I received a leter from some woman in the HO that in order for her to consider my application for a residence card as a family member of an EEA national I should send her my wife's recent payslip, her passport and more payslips from myself. She also enclosed a METHOD OF ENTRY QUESTIONNAIRE for me to complete :x When I saw the letter I was livid cos d basis she is considering my application is a wrong one. I simply sent her my current payslips as that is required by paragraph 6 of ragulation 10.( the regulation I based my application on) I sent her the METHOD OF ENTRY QUESTIONNAIRE uncompleted telling her is inrelevant to me cos I have been admitted into UK on several occasion as the family member of an EEA national and she saw all those stamps in my passport. The buttom line is, do not be intimidated by HO, always know ur rights. I am waiting for her to grant me what I seek for and if she refuses,I shall see them in COURT!
