I am non-EEA citizen married to an EEA citizen. I have been living in the UK for more than a year. My family member visa expired last August and my husband, then, applied for five-year residence. The thing is that we still have not got the visa and I was offered a job now. The problem is that my visa had already expired for two days when we sent the application.

Does anyone know if I still have the right to work here while my visa hasn't been issued considering the visa was expired when we sent the application to the Home Office? Other question: how can I prove to my future employer that I have the right to work here.

Hi there,

Answer to all your questions is YES!
You can work leagaly while your case is being consided..2 days delay is of no importance.NIN or any previous papers from IND should be ok.Just explain your situation to your employer.

Wouldn't worry about the employer. They are quite happy if you have a national insurance number.

The immigration people are pretty laid back about these permits anyway seeing as they can't actually turn you down.
