EEA2 Application for Canadian Spouse of Irish Citizen

Postby jmcarson » Sun Dec 14, 2008 9:46 pm

Hello all, my wife applied to stay in the country using the EEA2 application form about 2 weeks ago.

We are living in Northern Ireland and I am an Irish Citizen.

We have not received a COA yet. How long should it take to get the COA?

She originally entered the UK on a visitor visa. She came over with me to look after my father. Since then we have decided to stay. We have been married for 9 years and have 2 children who are in school. There is no point in us going back to Canada now. We have money in the bank and I just started up my own business. We also own a house here and we enclosed a letter from our lawyer saying that we own the property and are living in it.

I guess I'm wondering if there is anyone else on here who has gone through a similar process for an EEA2 application. What are the timelines and what are the chances of her being allowed to stay?

Thanks.

Unfortunately the time line is quite long even under normal circumstances. You should get the CoA within 1 to 3 months, but you may be able to get a must faster response if you complain. The processing of the application takes about 8 months at the moment. There is some hope that the back log will clear, and the duration will come down a bit next year.

Applying from a visitor visa makes the process a bit more complicated, because your situation has not been assessed before. I am not sure whether that has any influence on how long it takes - and I guess the impact on the time line should be minimal in any case.
