Thank you so much for your help.
Today I will call IND. I already wrote e-mail to them, but no answer. So the only way to contact with them is the telephone :)
We are going to UK on 03.08.2005 and I have to find out everything.

info. for Aleksandra

Postby Anna Sayan » Wed Jul 20, 2005 7:05 am

Hi Aleksandra,

I just called UK Embassy in Poland (0048 22 311 00 00, from 8.30 - 10.00) to check about family permit and about the right of our spouses.

The first important thing - please check family permit in your spouse's passport. What they are writing there? If "to join" - he can work there right now. But you both going to UK (like me and my husband), so probably they are writing there "to accompany".
So YOU should find job as soon as possible. If you will find something, just jump on it :) I will do the same.
We have to find job before our husband's family permit visa will expire.

After finding job, we have to register with WRS. Then we can register our husbands (EEC3, putting on form our WRS details - like our friend wrote earlier). Then our husband will get a special stamp, about which I was writing before. And that's it. Then our husbands can work.

I hope I helped you a little.
I hope you feel well.

Take care,
Ania Sayan

Hey Anna,
I am so glad we finally got asnwers we needed, although I will feel even better when somebody from IND confirms this.
I am already looking for work, it's not easy. When you get here go to Jobcentre each morning and call or send CVs wherever you can. Additionally to that I am going to knock from door to door until someone hires me.
Anyway, my husbands Family Permit doesn't mention "to join" or "to accompany", because half of the sentence is broken. I am sure though that it is supposed to say "to accompany" cuz we arrived here together.

Also, I am NOT sure if I am right but I read somewhere on the Internet that family permits (even thogh they are for 6 months only) are valid for unlimited time as long as the person holding it stays inside the UK.
If the person leaves the UK after he permit is expired already, he has to apply for a new one before entering the UK again. I'll try to find that information and give you the link.

Where in lOndon are you going to stay?

Aleks

Hi Aleksandra,

First about passport and visa which they put in your husband's passport. Probably they wrote "TO ACC SPOUSE" or sth like that. We checked yesterday with my husband at his passport.

Today I will try to call IND and find out something more. Still they didn't answer to my e-mail so the only way to find out, is to call them.

We were planning to go to London, but mu husband's family is going for a holiday and we don't want to stay there alone. His another cousin is in Crawley, about 30 min from London and we decided to go there. Crawley is expensive as London

I hope you will find job soon. I have to work in Warsaw till the end of the month, then I have 2 days free and we are flying.

Good luck about everything.

for Aleksandra - e-mail from IND

Postby Anna Sayan » Fri Jul 22, 2005 5:58 am

Hi Aleksandra, I just got e-mail from IND :) Please read.

Dear Anna
Thank you for your enquiry of 18th July 2005.
Your husband holds the EEA Family Permit, this will entitle
him to live and work in the UK all the while you are in the UK
too.

When you find a job you will need to register with the Workers
Registration. Telephone number for information is 0114 259 6262.
Once you are registered and working your husband can apply on
the EEC 3 Application Form, this will extend his six month family
permit.

Yours sincerely

Daphne,

Just read your reply here before aleks721 (she's actually my wife). Based on what you said above, I have an inherent right to work based on my association/relation to my wife (whose the EEA National) and should IND ask for proof, I have our marriage certificate documents plus my visa says VISA EEA Family Permit: Family Member, which we applied in the UK Embassy in New York (as we were in the US at the time).

I guess now, having read other threads and replies here, it's 2 scenarios:

Scenario A:
My wife finds work first before me, thus registers for WRS, and once she receives her card and other documents, I apply for the residence permit via the EEC3 form, of whcih will include her WRS reference number, and then this permit actually takes over the family permit I originally have that expires January 2006.

Scenario B:
I find work first than her (the right to work has been established above), and my wife files for the residence permit EEC1 form, citing "self sufficient person" as my employment and salary is enough to support her. When we get the approval, does this mean that we basically "bypassed" the waiting time in scenario A for her to work for 12 months prior to filing for the residence permit, and that we now have the right of free movement, just like other Brits?

Do help clarify if you can. Thanks a bunch!

Sorry for the Polish bit. Will continue in English..

Ania,

My husband called the IND about 3 weeks ago and the officer told him good news, our husbands CAN WORK right away after we arrive in the UK. My husband is already looking for work actively and has attended a few interviews so far.

Anyway, he has posted a long mesage on this forum so please read it as it will give you a very clear picture of our situation.

Hope you're enjoying London as much as I do.

Cheers,
Aleksandra
