thanks for the site first of all ... well my situation is not new tho i find it bit difficult to explain about ma situation ......

We applied for the visa in India on the 5th of July 2010 after consulting the Hungarian representative name:- Havasi Szoták Csillával in Indian mission for the 3rd time last we applied visa was on 17th of Feb 2010 after consulting the embassy .she’s working as consulates adviser she advised us to bring the following documents which were needed to file visa and she also suggested we need to file C type visa not family reunion visa.

So we went to the embassy on the July 5th, 2010 first my appointment was canceled 2 times in a week as my wife was also present and she talked to the consulate if he can help us to apply. After a while we went for the interview. They asked me few questions related to Hungary and some personal it was fine. Then my wife went for the interview, the person who was conducting her interview to him she told, I am Hungarian national I came from Hungary to India to accompany my husband because this is his first trip to Hungary to visit my family and friends. This my fourth time I am coming to India to meet my husband and to accompany him in his trip with “Us” (my wife and her colleague Judit who was in India)
That suggest they have uniform format for the person who is coming from Hungary, has to go through the same questioner what is meant for the person leaving to Hungary.
I have never committed a crime in my country nor in other state in support to that I have police clearance if its required I can provide you that, I have my medical done which suggest am not suffering from any hazardous disease. If you really would like to know about the family you can ask her family, friends or colleagues working along with her even her boss in support to that we can provide you the phone nrs. You can contact them anytime even that didn’t work out her colleague who came along with her in India lived at my home and she had a great time too. So it’s not about the directive but the facts what we have provided to you in the visa plea.
My wife visited me for the fourth time because for the last 2 times I didn’t have the visa as requested but those reason what were giving were not fair enough to judge that I am a misfit I have never applied for any other country I applied only for Hungary for last 2 times because my wife is Hungarian I don’t want to go anywhere else without my wife.
The only reason was we would like to live sometime in Hungary because in last December 2010 we purchased a house and it was under construction we have papers for that my wife has permanent job in XXX and everybody knows about our marriage and they know me for good. My father was supportive enough he also provided me his funds so that it won’t be a hassle to go along with my wife.

The documents we presented in front of them were as per the norms:-
For the visa applicant are as follow:-

1. filled form duly signed by wife and mine
2. invitation letter
3. medical insurance for 3 month for 1 lakh
4. valid Itinerary
5. proof of funds more than 8000 euro for 10 days trip
6. flat allotment copy along with affidavit made by notary under signed by father in India suggesting my share in the property
7. support letter made by notary singed by father for the funds because we have a joint account
8. bank statement of join account with my father
9. Marriage Certificate Both Indian and Hungarian ( appostile ) (with affidavit )
10. 3 years tax paper and tax card copy
11. passport

Other supporting documents of my wife

1. Passport copy old and new under name Ildiko Nanda
2. 4visa copy including the old ones under the name ildiko Kokai
3. New cards including residence card and other cards from driving licence to all under the name ildiko Nanda
4. Salary Certificate From Company
5. Employment Certi (from Company)
6. Tax Papers
7. Ownership Paper of Her House In Hungary

The Refusal letter states

x Embassy of Hungarian republic

This decision was made based on the followings

1. attached fake documents
2. didnt proov the planeed stay porpuse and circumstances
3. didnt attach proof of money fund for the stay , for the living, or for the return to the mother country, or to a travel to a third country,or you are not in a position to show this proof of fund
4. in the six month period already spent 3 in the territory of the schengen countries
5. in the schengen information system(SIS) there is an order against crossing the border, wich note was done one of the countries


x 6. One ore more schengen country finds that according to the 562/2006/EK law(Schengen border crossing codex) 2.clause , 19.th par you can breach the peace, or the inner order, or the public health, or the national relationships of the schengen countries.
7.you didint proof tht you own the accurate and valid health insurrance
x 8. the attached informations as the reason of stay and circumstances could not be taken as relaible informations
9.could not be decided surely weahter you intend to leave the territory of schengen countries before the your visa expires
10.reason of visa requet at border wasnt prooved why visa could have not beend requested in advance
11cancellation of visa was requested by visa owner.

Comments:
Related person can make a complaint accordin to the international law against the refused visa.
Related person should give this documentation to all the schengen countries, must provide the related laws and the actions could be done, also the competent authority also, and the legal redress where the complaint could be adressed to , and the deadline of the complaint also.
